Introduction

Welcome to SkillSwap. These Terms of Service ("Terms") govern your access to and use of the SkillSwap platform, including any content, functionality, and services offered on or through our website and mobile applications (collectively, the "Platform").

Please read these Terms carefully before using the Platform. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

Eligibility

To use the Platform, you must be at least 16 years old and capable of forming a binding contract. By using the Platform, you represent and warrant that you meet these requirements.

Account Registration

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to disable any user account at any time if, in our opinion, you have violated any provision of these Terms.

Platform Rules

When using the Platform, you agree not to:

• Violate any applicable law, regulation, or third-party rights
• Use the Platform for any illegal or unauthorized purpose
• Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
• Interfere with or disrupt the Platform or servers or networks connected to the Platform
• Attempt to gain unauthorized access to any part of the Platform
• Use the Platform to collect or store personal data about other users without their express consent
• Use the Platform to transmit any malware, spyware, adware, or other harmful code
• Engage in any activity that could disable, overburden, damage, or impair the Platform

Skills and Services

SkillSwap is a platform that allows users to exchange skills and services. When offering or requesting skills:

• You must provide accurate descriptions of your skills and services
• You are solely responsible for the content and services you provide
• You must not offer or provide any illegal or prohibited services
• You must honor your commitments to other users
• You understand that SkillSwap does not guarantee the quality, safety, or legality of any skills or services offered

Token System

SkillSwap uses a token-based system to facilitate skill exchanges. By using the Platform, you agree to the following:

• Tokens have no monetary value and cannot be exchanged for cash
• Tokens can only be used within the Platform
• SkillSwap reserves the right to modify, suspend, or terminate the token system at any time
• You may not sell, transfer, or trade tokens to other users outside the Platform's intended functionality
• We reserve the right to adjust token balances in cases of fraud, technical errors, or policy violations

Pro Subscription

SkillSwap offers a premium subscription called "Pro" with additional features. By subscribing to Pro:

• You agree to pay all fees associated with the subscription
• You authorize us to charge your payment method for the subscription fees
• Your subscription will automatically renew unless you cancel it before the renewal date
• We reserve the right to change the subscription fees upon notice
• No refunds will be provided for partial subscription periods

User Content

The Platform allows you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("User Content"). You are responsible for the User Content that you post, including its legality, reliability, and appropriateness.

By posting User Content, you grant SkillSwap a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit such User Content in connection with the Platform.

Intellectual Property

The Platform and its original content, features, and functionality are owned by SkillSwap and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform without our prior written consent.

Termination

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, for any reason, including, without limitation, if you breach the Terms.

Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the Platform or delete your account.

Disclaimer of Warranties

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. SkillSwap expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

SkillSwap does not guarantee that the Platform will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

Limitation of Liability

In no event shall SkillSwap, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Platform.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
